AK telemarketing rules

Alaska telemarketing rules

Alaska requires telephone sellers to register with the Department of Law at least 30 days before a solicitation campaign, bars solicitations to numbers on the national do not call registry, and makes automated or recorded message sales calls a consumer protection violation.

From official sources, checked September 26, 2026. General information, not legal advice.

Key facts

  • A separate notice of intent must be filed with the Department of Law for each solicitation campaign.
  • Registration is not complete until the Department of Law sends an acknowledgement that the seller has complied.
  • Selling or attempting to sell by telephone without complying with the registration requirement is a class C felony.
  • The Department of Law says exempt sellers must still give the required disclosures in the first 15 seconds and end the call if the consumer objects.

Registration with the Department of Law

AS 45.63.010, 45.63.080; 9 AAC 14.010

A person may not sell or attempt to sell property or services by telephone, making substantially the same offer on substantially the same terms to two or more persons, unless registered with the Department of Law at least 30 days before the solicitation campaign. Registration includes a notice of intent for each campaign, an irrevocable consent appointing the department to receive service of process, and a signed statement that the seller will comply with the chapter. Exemptions include licensed real estate, insurance, and contractor businesses acting within their licenses, and callers who complete the sales presentation only at a later meeting in person, unless they then try to collect payment for items delivered before that meeting.

The national do not call registry and company requests

AS 45.50.475(a)(2), (a)(3), (d), (g)

Alaska makes it a consumer protection violation to make a telephone solicitation to a customer whose number has been on the national do not call registry for the minimum time the registry requires, or to a customer who told the caller, or the business it calls for, that they do not want such calls to that number. An employer is not liable if it adopted written procedures, trained its staff on them, and the call was a good faith error made contrary to those procedures. Calls answering the customer's request, and calls to people who bought from the business within 18 months and have not asked for the calls to stop, are not telephone solicitations under the statute.

Automated or recorded message calls

AS 45.50.475(a)(4)

It is a violation of Alaska's consumer protection law to originate a telephone call using an automated or recorded message as a telephonic advertisement or a telephone solicitation. The Department of Law's telemarketing page states the rule the same way when it describes Alaska's do not call law. Department regulations require each registration notice of intent to include a statement describing how the seller will comply with this rule and with the do not call rules in the same statute.

Calling hours

47 CFR 64.1200(c)(1)

The Department of Law's telemarketing page, in its summary of the telemarketing rules adopted by the FTC, says a telemarketer may only call between 8:00 a.m. and 9:00 p.m. The FCC rule bars telephone solicitations to any residential telephone subscriber before 8 a.m. or after 9 p.m., local time at the called party's location. The Alaska telemarketing statutes and regulations reviewed for this page do not set a separate calling window.

Disclosures, hang ups, and written contracts

AS 45.63.020, 45.63.045

Within the first 15 seconds of a call, a telephone seller must clearly disclose the registered seller's name and telephone number, whom it represents, and that the call is a sales call. The seller must end the solicitation and promptly disconnect if the person objects or says they are not interested. Until it receives a signed, written contract from the buyer, a telephone seller may not solicit payment, charge a credit card, negotiate a check, or accept cash for the purchase.

Calls to businesses

AS 45.50.475(g)(4); AS 45.63.080

Alaska's do not call statute defines telephone solicitation to exclude business to business calls, while covering solicitation at a customer's residence or on a customer's cellular or mobile telephone. The registration chapter's exemptions are listed by type of seller or sale, such as securities, licensed real estate and insurance, newspapers, and businesses regulated by the Regulatory Commission of Alaska, and that list does not include a general business to business exemption.

Recording calls

AS 42.20.300(b), 42.20.310

Alaska's eavesdropping law says a person may not use an eavesdropping device to hear or record all or any part of an oral conversation without the consent of a party to the conversation, and the section covers conversations held in person, by telephone, or by other means. A separate section bars a person who is not authorized by a party to the communication from intentionally intercepting a private communication.

Questions

Can we use prerecorded or automated messages for sales calls in Alaska?

Alaska's statute makes it a violation of the state's consumer protection law to originate a telephone call using an automated or recorded message as a telephonic advertisement or a telephone solicitation. The Department of Law's telemarketing page repeats that rule.

How far ahead must a telemarketer register in Alaska?

The Telephonic Solicitations Act requires registration with the Department of Law at least 30 days before the solicitation campaign. Registration is complete only when the department sends an acknowledgement, and a separate notice of intent is filed for each campaign.

Do Alaska rules apply to sellers that are exempt from registration?

The Department of Law says exempt sellers must still honor buyers' cancellation rights, give the required information in the first 15 seconds of the call, and end the call if the consumer objects or is not interested. The statute's exemptions reach registration, the written contract rule, and parts of the cancellation section, but not the disclosure and hang up rules.
