Oklahoma requires prior express written consent for automated sales calls, limits commercial solicitation calls to 8 a.m. to 8 p.m. and three per person in 24 hours on the same subject, keeps a state do not call registry, and registers nonexempt sellers.

A person may not make or knowingly allow a commercial telephonic sales call that involves an automated system for the selection or dialing of telephone numbers, or the playing of a recorded message, without the called party's prior express written consent. A called party aggrieved by a violation may sue for an injunction and damages, and a court may increase the award for willful or knowing violations.
Prior express written consent is a signed written agreement that clearly authorizes sales calls, texts, or voicemails using an automated system or recorded message and includes the number to be called. It must clearly and conspicuously disclose that signing authorizes those calls and is not a condition of any purchase. Electronic or digital signatures count where federal law or state contract law recognizes them.
A commercial telephone seller or salesperson may not make a commercial telephone solicitation call before 8 a.m. or after 8 p.m. local time in the called person's time zone. It also may not make more than three such calls from any number to a person over a 24 hour period on the same subject matter or issue, regardless of the number used. Both limits cover automated dialing and recorded messages.
A commercial telephone seller must register with the Attorney General at least 10 days before doing business in Oklahoma, which includes soliciting purchasers located there. Registration lasts one year, lapses if not renewed by its anniversary date, and requires a bond, and individual employees do not register. The application lists every number the seller will use and its required sales scripts. Persons regulated by the Insurance Commission or the Oklahoma Real Estate Commission, and sellers who complete the sale only at a later face to face meeting, fall outside the seller definition.
The Attorney General keeps a registry of consumers who do not want unsolicited telemarketing sales calls or messages, including texts. A telemarketer may not call or message a listed consumer more than 30 days after the number first appears. Calls within an established business relationship, which includes one formed in the preceding 24 months, are not violations, and telemarketing excludes a call made only to arrange a later face to face meeting between a salesperson and the consumer.
The do not call law defines a consumer as a natural person resident in Oklahoma and leaves out business entities. The registration law does not cover a person soliciting only business purchasers who previously bought identical or similar goods or services from the business being represented. The 2022 Act exempts certain business to business sales, such as sales to a business that intends to resell the goods.
A caller must transmit its number, and its name when the carrier makes it available, to caller ID, or may show the seller's name and a customer service number answered during regular business hours, and may not display a different number to conceal its identity. Using equipment that automatically dials more than one person at a time is an unlawful practice when abandoned calls exceed 5 percent of answered calls per day in any campaign.
Oklahoma law says it is not unlawful for a person not acting under color of law to intercept a wire, oral, or electronic communication when that person is a party to it or one party has given prior consent, unless the purpose is to commit a criminal act.
Yes. A commercial telephone seller or salesperson may not make more than three commercial telephone solicitation calls from any number to a person over a 24 hour period on the same subject matter or issue, regardless of the number used.
The Telemarketer Restriction Act does not count a call made only to arrange a later face to face meeting between a salesperson and the consumer as telemarketing. The 2022 Act's consent, hours, and call limit rules are a separate law with their own exemptions.
The seller definition leaves out a telephone marketing service company operating at least five years under the same name whose services are at least 75 percent for exempt sellers. The same paragraph says this does not exempt a commercial telephone seller that contracts with such a company from registering.
