Indiana keeps its own do not call list, counts texts as telephone sales calls, requires consent or a live operator before automated messages, limits automated sales messages to 9 a.m. to 8 p.m., and bars transferring a live call placed in violation.

The Attorney General's consumer protection division publishes a quarterly listing of Indiana consumers who do not want telephone sales calls, and a telephone solicitor may not make or cause a telephone sales call to a number on the current listing. Anyone who obtains consumer information with telephone numbers must exclude listed numbers. Express request calls, calls about an unfinished debt or contract, and defined calls by charities, newspapers, licensed real estate and insurance professionals, broadband providers, and financial institutions are excluded.
A telephone solicitor, supplier, or caller may not transfer a live call to other persons if the call was placed to a consumer in violation of the do not call article or the automated dialing chapter, and may not share a consumer's number for solicitation knowing it is on the current Indiana list. Giving substantial assistance to a violator while knowing, or consciously avoiding knowing, of the violation is barred too, except for communications service providers that only transport the calls.
Indiana's registration chapter covers sellers whose solicitations include listed representations, such as a false gift or prize claim, certain reduced price vacation offers tied to time share presentations, misrepresenting who is calling or who makes the product, or certain offers of precious metals, minerals, or oil and gas interests. Such a seller registers with the consumer protection division before doing business in Indiana, files its telephone numbers and sales scripts, and updates the filing each August 1.
A caller may not use an automatic dialing announcing device, which selects and dials numbers and plays a prerecorded or synthesized voice message, unless the subscriber knowingly or voluntarily requested, consented to, permitted, or authorized the message, or a live operator obtains consent first. That operator must first disclose the business, the purpose, the goods or services promoted, and whether payment is sought. Messages to subscribers with a current business or personal relationship with the caller are exempt.
A caller may not use an automatic dialing announcing device for commercial telephone solicitation so that a subscriber receives the call before 9 a.m. or after 8 p.m. That term means an unsolicited call to solicit a purchase from a subscriber with no prior business or personal relationship with the caller. Federal rules separately bar telephone solicitations to residential subscribers before 8 a.m. or after 9 p.m., local time.
A telephone solicitor must immediately give their true first and last name, the business they call for, and the person that employs or contracts with them. Knowingly blocking caller ID on a solicitation outside the course of dealing is barred, as is knowingly sending misleading caller ID with intent to defraud or cause harm. Unless an exception applies, a contract from a telephone sales call binds the consumer only if written, signed by the consumer, and compliant with the statute's other terms.
The do not call article protects consumers, defined as Indiana residential telephone subscribers who are actual or prospective buyers of consumer goods or services or charitable donors, and the Attorney General says business numbers cannot be placed on the Indiana list. The automated dialing chapter instead uses subscriber, meaning a person who subscribes to telephone service or lives with one, and bars automated calls to hospitals, fire departments, and law enforcement agencies.
For its wiretap article, Indiana defines interception as the intentional recording or acquisition of an electronic communication's contents by a person other than a sender or receiver, without the consent of the sender or receiver. Electronic communication includes sounds and oral communication sent by wire or radio, and knowingly or intentionally intercepting a communication in violation of the article is a Level 5 felony.
Yes. Indiana's definition of a telephone sales call includes text, graphic, image, photo, and multimedia messages sent by SMS, MMS, over the top messaging, or similar technology, and the Attorney General says a telemarketer may not text a solicitation to a wireless number on the Indiana list.
Indiana bars a telephone solicitor, supplier, or caller from transferring a live call to other persons if the call was placed to a consumer in violation of the do not call article or the automated dialing chapter. It also bars knowingly giving substantial assistance or support to someone who violates those laws.
Seller registration applies to sellers whose solicitations include representations listed in the statute, such as false gift or prize claims or offers of precious metals or mineral interests. Separately, a telephone solicitor may obtain the Indiana do not call listing from the consumer protection division.
