KS telemarketing rules

Kansas telemarketing rules

Kansas uses the National Do Not Call Registry as its no call list, requires telephone solicitors to consult it at least every 30 days, requires callers to identify themselves and the purpose of the call, and bars withholding caller ID.

From official sources, checked September 26, 2026. General information, not legal advice.

Key facts

  • Kansas law designates the national no call list kept by the Federal Trade Commission as the Kansas no call list.
  • The Kansas No Call Act covers calls to the residence or mobile telephone number of a consumer.
  • An established business relationship under the act must come from an application, purchase or transaction within the 18 months before the call.
  • Kansas makes it a crime to intercept a telephone message without the consent of the sender or receiver.

Kansas uses the national registry

K.S.A. 50-670a

The Kansas No Call Act names the national no call list maintained by the Federal Trade Commission as the Kansas no call list, and the Attorney General directs consumers who want to register to the federal list. Before making unsolicited consumer telephone calls in Kansas, and at least every 30 days after that, a telephone solicitor must consult the list and delete listed numbers from its calling list. The act bars unsolicited consumer telephone calls to listed numbers and bars using the list for any other purpose.

What makes a call unsolicited

K.S.A. 50-670(a)

The act's rules apply to unsolicited consumer telephone calls. A call is not unsolicited if it is made in response to an express request or with the express written agreement of the person called, if it is mainly about an existing debt or contract that has not been completed, or if the caller has an established business relationship with the consumer. That relationship must come from an application, purchase or transaction within the 18 months before the call and must not have been ended by either party.

Identification, caller ID and automated calls

K.S.A. 50-670(b), (c)

A telephone solicitor making an unsolicited consumer telephone call must identify themselves, identify the business they are calling for, and state the purpose of the call immediately on contact. The caller must promptly stop if the person gives a negative response. A live operator or an automatic dialing announcing device must answer the line within five seconds of the beginning of the call, and a device message may give only the caller and business identification, with no unsolicited advertisement. A telephone solicitor may not withhold its number from caller ID when that number is used for telemarketing.

Calling hours

47 CFR 64.1200(c)(1)

The two sections of the Kansas No Call Act do not set a calling window of their own. Federal rules bar telephone solicitations to residential subscribers before 8 a.m. or after 9 p.m. local time at the called party's location. The federal Telemarketing Sales Rule, absent prior consent, sets the same window for outbound telemarketing calls to a person's residence.

Calls to business numbers

K.S.A. 50-670a(f)

The act defines a consumer telephone call as a call to the residence or mobile telephone number of a consumer. A telephone solicitor has an affirmative defense to a no call violation if it shows by clear and convincing evidence that the consumer listed or held out that residential or mobile number to the public as a business number, that the caller knew of and relied on that, and that the call was directly related to the consumer's business.

Signed confirmation for telephone sales

K.S.A. 50-672 and 50-673

A separate Kansas law says a consumer's verbal agreement to buy goods or services from a telemarketer is not valid and binding unless the telemarketer receives a signed confirmation disclosing the full terms of the sale. The confirmation must include items such as the telemarketer's name and contact details, the date and a detailed description of what is sold. Exceptions include transactions where the business has made a prior sale to the consumer, is establishing a business to business relationship, or has a clear preexisting business relationship, subject to conditions.

Recording calls

K.S.A. 21-6101

Kansas defines breach of privacy to include intercepting a message by telephone or other private communication without the consent of the sender or receiver. It also covers using a device to intercept a telephone communication without the consent of the person in control of the facilities. House Bill 2479, which amended the section effective July 1, 2026, changed the mental state for the crime and kept the sender or receiver consent wording.
