Key facts

  • Wyoming's law covers businesses that make telephonic sales calls from a Wyoming location or from other states or nations to consumers in Wyoming.
  • A telephonic sales call includes a call made to obtain information that will or may be used to directly solicit a sale of consumer goods or services.
  • The Wyoming Attorney General enforces the telephone solicitation article and may seek civil penalties and injunctive relief for willful violations.
  • The Attorney General says the Federal Trade Commission's National Do Not Call List is separate from Wyoming's do not call list.
  • Under Wyoming's home solicitation sale section, a personal solicitation at the buyer's residence includes contact by telephone, and the buyer generally may cancel such a sale until midnight of the third business day after signing.

Notice filing with the Attorney General

Wyo. Stat. 40-12-305

Each telephone solicitor or merchant that makes unsolicited telephonic sales calls and does business in Wyoming must file a statement with the Attorney General giving notice of that fact. The statement designates the Secretary of State as its agent for service of process for alleged violations of the article, unless a lawful resident is designated instead, and states the caller's intention to abide by the article. The statute says complying with this section does not subject the caller to any other state statute.

Calling hours

Wyo. Stat. 40-12-301(a)(xii); 40-12-302(d)

No telephone solicitor may initiate an unsolicited telephonic sales call to a consumer before 8 a.m. or after 8 p.m. local time at the consumer's location. A call is not unsolicited if it is made at the express request of the person called, primarily about an existing debt or contract not yet completed, to someone with whom the caller has an established business relationship, or by a telephone solicitor or merchant making fewer than 225 unsolicited calls per year.

Wyoming's do not call list

Wyo. Stat. 40-12-301(a)(viii), 40-12-302(b), 40-12-304(e)

No telephone solicitor or merchant may willfully make an unsolicited telephonic sales call to a residential, mobile, or paging number more than 60 days after it appears on the national do not call list. The statute defines that list as the one kept by the Telephone Preference Service of the Direct Marketing Association, or its successor organization, and the Attorney General's page tells residents to enroll through that service. The rule does not apply to calls to a seller or lessor of real property made in response to a yard sign or other advertisement. A good faith error is an affirmative defense in an action by the Attorney General.

Automated and recorded sales calls

Wyo. Stat. 40-12-303

No telephone solicitor or merchant may make, or knowingly allow, a telephonic sales call that involves an automated system for selecting or dialing numbers or playing a recorded message when the call connects. The statute allows an automated telephone dialing system with live messages in three cases: the calls respond to calls the recipients started, the numbers were screened to exclude every subscriber on the national do not call list and any unlisted number, or the caller has an established business relationship with the consumer. This section is written for telephonic sales calls generally, not only unsolicited ones.

Disclosures, caller ID, and unpublished cell numbers

Wyo. Stat. 40-12-302(a), (c), (e); 40-12-301(a)(xi)

At the outset of an unsolicited telephonic sales call to a residential or mobile number, the caller must clearly disclose the individual caller's name, the identity of the telephone solicitor or merchant with a telephone number and address where it can be reached, that the purpose is to sell consumer goods or services, and the nature of those goods or services. A caller may not knowingly block or circumvent a residential subscriber's caller identification service. No unsolicited telephonic sales call may go to an unpublished cellular number, meaning one the subscriber has not asked to have listed and whose prefix or number the Public Service Commission has found to be primarily cellular.

Calls to businesses

Wyo. Stat. 40-12-301(a)(ii), (iii), (ix)

Each rule in Wyoming's telephone solicitation article applies to telephonic sales calls, which the statute defines as calls made to a consumer to solicit a sale of, or an extension of credit for, consumer goods or services, or to gather information for such a solicitation. Consumer goods or services are real property, personal property, or services marketed and intended for personal, family, or household purposes, including property to be installed in real property, cemetery lots, and timeshare estates. The article has no separate section on calls to businesses.

Recording calls

Wyo. Stat. 7-3-702(a), (b)(iv)

Wyoming's interception statute does not prohibit a person from intercepting an oral, wire, or electronic communication when the person is a party to it or one of the parties has given prior consent, unless the interception is for the purpose of committing a criminal or tortious act. The general prohibition covers intentionally intercepting, using, or disclosing such communications outside the listed exceptions.

Questions

Is Wyoming's do not call list the same as the National Do Not Call Registry?

The Attorney General says the Federal Trade Commission's National Do Not Call List is separate from Wyoming's list. Wyoming's statute defines its national do not call list as the list kept by the Telephone Preference Service of the Direct Marketing Association, or its successor organization, and bars unsolicited sales calls to listed numbers more than 60 days after they appear.

Can a call center use a dialer for sales calls into Wyoming?

Wyoming bars telephonic sales calls that involve an automated system for selecting or dialing numbers or playing a recorded message when the call connects. An automated telephone dialing system with live messages is allowed when the calls respond to calls the recipients started, when the numbers were screened against the national do not call list and unlisted numbers, or when there is an established business relationship.

Does Wyoming exempt small callers?

The calling hours, disclosure, caller ID, do not call, and notice filing rules are written for unsolicited telephonic sales calls. The statute defines those to exclude calls by a telephone solicitor or merchant making fewer than 225 unsolicited calls per year. The automated sales call section is written for telephonic sales calls generally.
