Idaho requires most telephone solicitors to register with the Attorney General before calling, lets the National Do Not Call Registry serve as its state list, requires opening disclosures in automated messages, and sets no calling hours beyond the federal window.

A telephone solicitor must register with the Attorney General at least 10 days before conducting business in Idaho, name the Attorney General as agent for civil process, and renew each year. The Act exempts from these duties isolated transactions, sellers whose telephone solicitations made less than 60 percent of the prior year's sales, calls to prior purchasers, businesses licensed by an agency other than the Secretary of State that can revoke the license, and callers who seek no purchase on the call and only arrange a later face to face sales presentation.
Idaho law lets the National Do Not Call Registry serve as the Idaho no telephone solicitation contact list, and the Attorney General says Idaho does not maintain its own list. A telephone solicitor may not make a telephone solicitation to an Idaho resident's number listed for at least three months. The rule does not cover business numbers, minors selling for charity, or an established business relationship from the prior 18 months, unless the subscriber has asked not to be called.
Idaho defines an automatic dialing announcing device as one that selects and dials telephone numbers and plays a prerecorded or synthesized voice message. A person using one must disclose, at the outset of the message, the name of the person the message is for, its purpose, and the caller's contact information. The section sets these disclosures and contains no consent requirement of its own.
The Idaho Telephone Solicitation Act does not set calling hours. Federal FCC rules bar telephone solicitations to any residential subscriber before 8 a.m. or after 9 p.m., local time at the called party's location. The federal Telemarketing Sales Rule sets the same 8 a.m. to 9 p.m. window for outbound telemarketing calls to a person's residence made without that person's prior consent.
A telemarketer that already holds an account number may not charge the account because of the call unless the account holder first authorizes that specific charge, after clear disclosure of the account, the amount, and who will charge it. Verbal authorization must be audio recorded after telling the account holder, or confirmed with the last four digits of the account number, and authorizations are kept for two years.
A person soliciting a sale by telephone must first reveal that the purpose of the contact is a sale by stating their identity, the trade name they represent, and the kind of goods or services. A telephone solicitor must hang up immediately when asked and may not block or mislead caller ID as to its identity or trade name. Unless the purchaser has an unqualified right to return the goods or cancel for a full refund, the solicitor sends a written confirmation with a notice giving three business days to cancel.
The Idaho do not call section does not apply to telephone solicitations made to a subscriber's commercial or business telephone number. The rest of the Act refers to purchasers, defined as persons who are solicited to become or who become obligated to a telephone solicitor, and its definition of person includes corporations, partnerships, companies, and other business entities. The Act's findings note that Idaho residents and businesses have lost money or suffered harm from out of state telemarketing abuse.
Idaho's interception law makes it lawful for a person to intercept a wire, electronic, or oral communication when one of the parties has given prior consent, but unlawful to intercept any communication to commit a criminal act. Separately, the Act's rule on charges to accounts already on file requires telling the account holder when a verbal authorization is being recorded.
The Act exempts from registration and related duties a caller who does not intend to make or obtain provisional acceptance of a purchase during the call and only arranges a later face to face sales presentation that is not for collecting payment or delivering items. That exemption reaches only the registration and duties section, so the do not call rule and the list of unlawful acts still apply.
The Attorney General says Idaho does not maintain its own do not call list. Idaho law lets the National Do Not Call Registry serve as the Idaho list, and the Attorney General says Idaho law makes it unlawful to call Idaho numbers registered there.
The Act says that if a telephone solicitor violates any applicable provision, any contract of sale or purchase is null and void and unenforceable. The Attorney General adds that a solicitor that fails to register cannot enforce contracts entered into as a result of the unlawful solicitation.
