Colorado requires commercial telephone sellers to register with the Attorney General, requires telephone solicitors to register for and honor the Colorado no call list, restricts automated dialing systems with prerecorded sales messages, and allows call recording with one party's consent.

A commercial telephone seller may not conduct business in Colorado without registering with the Attorney General at least ten days beforehand. A seller conducts business in Colorado if it calls from a Colorado location or solicits prospective purchasers located in Colorado. Registration lasts one year. Exclusions include insurance sellers complying with title 10, supervised financial organizations and lenders, and a person who completes the sale only at a later face to face meeting. The Attorney General says its registration does not replace registration with the Colorado no call program.
The Public Utilities Commission administers the Colorado no call list through a designated agent. No person may make a telephone solicitation to a residential or wireless subscriber in Colorado who has added their number and zip code to the list. Anyone making telephone solicitations to residential or wireless subscribers in Colorado must register with the program and update its copy of the list within 30 days after the start of each calendar quarter. Calls made with the subscriber's prior express invitation or permission, within an established business relationship that exists or existed in the prior 18 months, or for up to 30 days after the subscriber asked a business about a purchase are not telephone solicitations under the Act.
Colorado's criminal code bars using an automated dialing system with a prerecorded message to solicit a person to buy goods or services, whether the solicitation happens during the message or in a later communication that results from it. The exception applies only when there is an existing business relationship and the person being called then consents to hear the prerecorded message. A violation is a petty offense.
Colorado's wiretapping statute applies to a person who is not a sender or intended receiver of a telephone communication and who records it without the consent of either the sender or the receiver. Its eavesdropping statute applies to a person not visibly present who records a conversation without the consent of at least one of the principal parties. Both statutes also reach recordings made for the purpose of committing, aiding, or abetting an unlawful act.
The Colorado no call list protects residential subscribers and wireless telephone service subscribers. The annotations in the Colorado Revised Statutes note Colorado appellate decisions holding that the Act has no exception based on using a listed residential number for business purposes, and that letting the number appear on commercial telephone listings does not remove the Act's protection. The telemarketing registration law excludes a person soliciting only business purchasers that previously bought identical or similar goods or services from the business the caller represents.
A commercial telephone seller must let a purchaser in a telephone sales transaction cancel by written notice until three business days after receiving the goods, services, or property, and must disclose that right during the solicitation. Those duties do not apply when the consumer can get a full refund by giving notice within seven days after receipt, the seller processes it within 30 days, and the terms are disclosed by telephone and in writing. Anyone making telephone solicitations to Colorado residential or wireless subscribers may not knowingly block or circumvent caller ID when its equipment can display the number.
Colorado's definition of commercial telephone seller excludes a person who does not complete the sale during the telephone solicitation and completes it only at a later face to face meeting, other than one held only to collect payment or deliver the item. The Attorney General accepts a claim of exemption form. The no call list rules apply to any person making telephone solicitations, separately from that registration.
The Public Utilities Commission says numbers from the National Do Not Call Registry are downloaded quarterly and included in the Colorado no call list. The statute also directs that the state list include the Colorado portion of the national database, to the extent federal law allows.
Colorado's registration law says a commercial telephone seller conducts business in Colorado if it calls from a Colorado location or solicits prospective purchasers located in Colorado. The no call law covers telephone solicitations to residential and wireless subscribers in Colorado.
